These Terms of Service (“Terms”) govern your access to and use of the BodyCam Analytics website and application (together, the “Service”), operated by BodyCam Analytics (“BodyCam Analytics,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1.Who may use the Service
The Service is intended for licensed attorneys, their staff, and other legal professionals using it in the course of legitimate legal work. You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a firm or organization, you represent that you are authorized to bind that organization to these Terms.
2.Your account
You are responsible for your account credentials and for all activity that occurs under your account. Keep your password secure, do not share your login, and notify us promptly at hello@bodycamanalytics.com if you suspect any unauthorized use.
3.Acceptable use and your right to the footage
You agree to use the Service lawfully, and only with footage and materials that you are legally entitled to possess, upload, and process — for example, evidence and discovery in matters you are handling. You agree not to:
- upload content you have no legal right to use;
- use the Service in violation of any law, regulation, protective order, or court order;
- attempt to disrupt, reverse engineer, probe, or gain unauthorized access to the Service or its infrastructure;
- use the Service to build or train a competing product; or
- upload malicious code or use the Service to infringe the rights of others.
4.Your content and ownership
You retain all rights to the footage, transcripts, review outputs, and other content you upload to or generate with the Service (“Your Content”). We claim no ownership of Your Content. You grant us only a limited, non-exclusive license to host, process, and transmit Your Content for the sole purpose of providing the Service to you — for example, to transcribe a file, generate review outputs, and deliver them back to you. This license ends when you delete the content or your account, subject to the retention periods in our Privacy Policy.
5.AI-generated output
The Service uses artificial intelligence to generate transcripts and review outputs. AI output can contain errors, omissions, or mischaracterizations.
Transcripts and review outputs are drafts, not certified records. You are responsible for verifying any quote, timestamp, speaker attribution, or characterization against the source footage before relying on it. The Service does not provide legal advice and is not a substitute for an attorney's professional judgment.
6.Subscriptions, billing, and cancellation
The Service is offered on monthly subscription plans. Each plan includes a set number of footage-transcription hours per billing cycle; footage beyond the included hours is billed at the plan's hourly overage rate, measured in one-minute increments. Fees are billed in advance and, except where required by law, are non-refundable. You can upgrade, downgrade, or cancel at any time from the billing page in the app. Cancellation takes effect at the end of the current billing period, and you keep access until then. We may change pricing on prospective notice; changes do not affect the period you have already paid for.
7.Confidentiality and your data
We handle Your Content as described in our Privacy Policy and Security page: encrypted in transit and at rest, not accessed by our personnel in the ordinary course of operating the Service, and deletable by you at any time. You remain responsible for your own professional obligations, including your duty of confidentiality to your clients and any court-imposed handling requirements for the evidence you process.
8.Service availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, with reasonable notice where practicable.
9.Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
10.Limitation of liability
To the fullest extent permitted by law, BodyCam Analytics will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or litigation outcomes, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
11.Indemnification
You agree to indemnify and hold harmless BodyCam Analytics from any claims, losses, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms or of applicable law.
12.Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially violate these Terms or use the Service in a way that risks harm to others or to the Service. On termination, the data-retention and deletion terms in the Privacy Policy apply.
13.Changes to these Terms
We may update these Terms as the Service evolves. Material changes will be posted here with a new “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14.Governing law
These Terms are governed by the laws of the United States and of the state in which BodyCam Analytics is established, without regard to conflict-of-law principles. Any dispute relating to the Service will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.
